If you need to get a simple, uncontested divorce in London, Ontario, the process can be quite simple and relatively quick, especially if you have the help of a family lawyer who can help you avoid the pitfalls that self-represented individuals often make when trying to navigate the court forms and processes involved for the first time.

If you and your spouse have been separated for at least one year and you both want to get a divorce without needing to litigate other issues like spousal support and property issues at the same time, then this is a process you may want to consider. A lawyer can make the process much easier for you by reviewing your case with you and drafting your forms properly, and also taking care of having your spouse served and dealing with the process of filing documents and paying court fees at every step instead of having you take time off of work and dealing with process servers on your own time.

We charge a flat all-inclusive rate of $1,975 (which includes all taxes and court filing fees) for simple and uncontested divorces. This fee applies in cases where both parties are applying jointly or where the location of the Respondent is known and they can be served without the need for special measures (which is the case in the vast majority of situations). Our office takes care of filing the documents, dealing with the Court, and getting your divorce order to you as soon as it is signed by the judge.

What do I need?

  1. Your marriage certificate, if it’s available. If you were married in Ontario, you can easily order a certificate online if you’ve lost the original. If you were married outside the country and it would be very difficult to obtain a copy of the the marriage certificate, it may be possible to proceed without one.
  2. Court fees of $632 (unfortunately, these fees were increased from $447 in 2019) or a fee waiver from the Court if you are very low income and cannot afford to pay the court fees.
  3. To have been separated from your spouse for at least one year before your divorce can be granted. Cases involving allegations of cruelty or adultery are more complicated.
  4. The correct forms – an application for a simple divorce or a joint divorce, an affidavit for divorce, and the “continuing record” documents that will be placed in the court file.

How can a London lawyer help me with a simple divorce?

A lawyer can review the court process with you and help you decide whether this is the appropriate path forward in your case to avoid wasting your time and money. They will draft your application, draft your affidavit for divorce and ensure that it includes the necessary child support information (if you have children, this is mandatory in Ontario even for a simple uncontested divorce), take care of having your spouse served (since you cannot serve your spouse yourself), prepare all of the necessary components of the court file (the continuing record, endorsement record, etc.), make sure that everything is properly filed with the Court, and obtain your divorce order and certificate of divorce. Barring any unusual complications, you won’t have to set foot in a courthouse.
