Motion to Change in London, Ontario

In Ontario, the Court makes a “final order” at the end of a family law case that may deal with things like child custody and access, child support, spousal support, and so on. These orders often don’t stand the test of time in spite of their name, because as life goes on, circumstances change. Maybe you or your spouse are making more or less money. Maybe it’s time for you to see more of your children, or for them to spend less time with a parent who is going through new difficulties that have come up in their lives. Perhaps someone is retiring, has new health problems, or is no longer in need of spousal support. When these things happen, a motion to change a final order can be brought to the court when the parties cannot agree on how to resolve the new situation themselves.

Changing an existing final order or obtaining a new court order is done through a Motion to Change, which is a court proceeding that changes or ends a previous court order. In the past this was called a “variation proceeding”, and you may still hear that term used from time-to-time. If the parties agree on a change to support amounts, custody, or other aspects of the order to be changed, then they can bring a Consent Motion to Change. Both parties will need to sign the Consent Motion to Change, which jointly requests that the court make a new order.
